This paper argues that there is an inconsistency between Jaegwon Kim's earlier work on supervenience and his more recent work on explanatory exclusion. In his work on supervenience Kim advocates an explanatory agnosticism that, by the time of his later work, is replaced by an endorsement of reductive explanation. My argument is that this tension between Kim's early and later work is unfortunate since explanatory exclusion is highly questionable in its own right and is not reconcilable with his earlier work (...) on supervenience anyway. /// El presente artículo sostiene que existe una inconsistencia entre los primeros textos sobre superveniencia de Jaegwon Kim y sus trabajos más recientes sobre exclusión explicativa. In 2009, health authorities from Taiwan formally attended the 62nd World Health Assembly of the World Health Organization as observers, marking the country’s participation for the first time since 1972. The long process of negotiating this breakthrough has been cited as an example of successful global health diplomacy. This paper analyses this negotiation process, drawing on government documents, formal representations from both sides of the Taiwan Strait, and key informant interviews. The actors and their motivations, along with the forums, practices (...) and outcomes of the negotiation process, are detailed. While it is argued that non-traditional diplomatic action was important in establishing the case for Taiwan’s inclusion at the WHA, traditional concerns regarding Taiwanese sovereignty and diplomatic representation ultimately played a decisive role. The persistent influence of these traditional diplomatic questions illustrates the limits of global health diplomacy. (shrink)

In this paper I will discuss three areas in which advances in human reproductive technology could occur, their uses and abuses, and their effects on society. First is the potential to drastically increase the success rate and availability of in vitro fertilization and embryo freezing. Second is the ability to perform biopsies on embryos prior to the onset of pregnancy. Finally, I will consider the adding or altering of genes in embryos, commonly referred to as genetic engineering.As new reproductive technologies (...) pass from experimental models into the potential for medical utilization, I believe that it will be important for lawmakers everywhere to avoid the impulse to outlaw procedures that a society believes to be unnatural at a first glance. Rather, I would hope that they can respond thoughtfully with legislation that serves two purposes — to protect the rights of couples to overcome infertility or to reduce the risk of genetic disease in their children-to-be, and more importantly, to protect children-to-be from the abuses that could result from some of the practices that I will discuss. The problem of epistemic circularity involved in justifying fundamental epistemic principles is one of the fundamental problems of epistemology. One important way out of this problem is a Sellarsian social practice theory of justification, according to which we are justified in accepting an epistemic principle if we can answer all objections raised against it in our social practice of demanding justification and responding to such demands. The main goal of this paper is to show that this social practice theory can (...) accomplish better than its rival theories, such as Alston’s doxastic practice approach, Sosa’s reliabilist virtue epistemology, and Wright’s entitlement theory, by making comparisons with these influential theories. Frederic Lee sets out the foundations of a post-Keynesian price theory through developing an empirically grounded production schema. The administered, normal cost and mark-up price doctrines are explained in parts I-III of the book, as many of their theoretical arguments are important for developing the foundations. This involves discussing the work of Gardiner Means, Philip Andrews, and Michal Kalecki as well as the developers of the doctrines, such as Edwin Nourse, Paolo Sylos Labini, Harry Edwards, Josef Steindl and Alfred Eisner. Ludwig Wittgenstein and Martin Heidegger are two of the most important--and two of the most difficult--philosophers of the twentieth century, indelibly influencing the course of continental and analytic philosophy, respectively. In _ Groundless Grounds_, Lee Braver argues that the views of both thinkers emerge from a fundamental attempt to create a philosophy that has dispensed with everything transcendent so that we may be satisfied with the human. Examining the central topics of their thought in detail, Braver finds that Wittgenstein and (...) Heidegger construct a philosophy based on _original_ _finitude_--finitude without the contrast of the infinite. In Braver's elegant analysis, these two difficult bodies of work offer mutual illumination rather than compounded obscurity. Moreover, bringing the most influential thinkers in continental and analytic philosophy into dialogue with each other may enable broader conversations between these two divergent branches of philosophy. Braver's meticulously researched and strongly argued account shows that both Wittgenstein and Heidegger strive to construct a new conception of reason, free of the illusions of the past and appropriate to the kind of beings that we are. The growing number of ‘smart’ instruments, those equipped with AI, has raised concerns because these instruments make autonomous decisions; that is, they act beyond the guidelines provided them by programmers. Hence, the question the makers and users of smart instrument face is how to ensure that these instruments will not engage in unethical conduct. The article suggests that to proceed we need a new kind of AI program—oversight programs—that will monitor, audit, and hold operational AI programs accountable.

In the asymmetrical variant of the two-envelope paradox, the amount in envelope A is determined first, and then the amount in envelope B is determined to be either twice or half the amount in A by flipping a fair coin. Contra the common belief that B is preferable to A in this case, I show that the proposed arguments for this common belief all fail, and argue that B is not preferable to A if the expected values of the amounts (...) in the envelopes are infinite. Using the examples I deploy in my arguments against the common belief, I also refute certain proposed solutions to the two-envelope paradox and draw some general lessons. (shrink)

This article focuses on Homers idea of reflexive rhetoric. The majority of Homeric deliberation scenes contain no deliberative calculi. One approach to this problem would be to generalize from the scenes where Odysseus uses deliberative calculi to those where he does not. One might argue, though, that data have to be transmitted to and outputted from a computer via interfaces, one where data are transformed into electrical impulses, and one where the output is printed as information. The deliberative calculus cannot (...) be the essential link between deliberation and persuasion, though it undoubtedly figures into the process of self-persuasion to the extent that it either explicitly or implicitly brings about a particular decision. In this perspective, the fact that Homer is frequently silent about deliberative calculi is irrelevant to the question of whether Odysseus persuades himself. The idea of Homeric rhetoric is alleged to pose the problem of anachronism. Moving toward an account of reflexive rhetoric allows to see in even greater detail the centrality of rhetoric to human condition. The growing demand for uterus transplantation (UTx) invites continued philosophical evaluation of the function of UTx (and what constitutes its ‘success’), as well as the recipient eligibility for UTx. Currently, UTx caters to partnered, cisgender women of childbearing age looking to get pregnant and give birth to a biogenetically related child. The medical justification for this—the treatment of uterine infertility—explains the primacy of this practice. However, this dominant conceptualization of UTx does not necessarily capture the diverse needs for which both (...) cis- and transgender women might take interest in UTx that are not strictly procreative, such as bodily integrity and gender identity reasons. In this paper, I argue that non-procreative motivations for uterus acquisition ought to be taken seriously as a matter of non-discrimination and consistency. (shrink)

This essay explores the controversy over peer-to-peer (p2p) software, examining the legal and ethical dimensions of allowing software companies to develop p2p technologies. It argues that, under the Supreme Court’s ruling in the Sony betamax case, technology developers must be accorded the freedom to innovate and develop technologies that are capable of substantial noninfringing uses. This doctrine, known as the Sony doctrine, provides an important safe harbor for technological development, including p2p. The safe harbor, however, does not immunize conduct beyond (...) the design, sale, or supply of the product. For other conduct that falls outside the Sony safe harbor, the traditional standards of secondary liability apply. (shrink)

Martin Heidegger is among the most important philosophers of the Twentieth Century. Within the continental tradition, almost every great figure has been deeply influenced by his work. For this reason, a full understanding of the course of modern philosophy is impossible without at least a basic grasp of Heidegger. Unfortunately, his work is notoriously difficult, both because of his innovative ideas and his difficult writing style. In recent decades in Korea, many significant changes in political, social and cultural dimensions have been held by the citizen’s initiative, where the revitalization of citizenship and strong civic unity have played a role. Yet, in regard to the characteristic of Korean citizenship, it seems that the aspect of individual subject has not been fully matured or issued; that is, there is a dissymmetry between the strong civic unity and a weak individual subject. This paper attempts to explore a possible (...) historical account of why this has been the case by examining the historical development of the concept of enlightenment in modern Korea and Japan. ‘Enlightenment’, as a modern concept in Korea, was imported via Japan in the period from the late nineteenth century to the early twentieth century as in many other new concepts such as ‘democracy’ or ‘nation’. However, by comparison to the Western idea of the Enlightenment, its modern concept, Korean or Japanese, developed a different meaning in each own context, while lacking its original meaning essential to the creation of the ‘modern individual subject’ as a ‘citizen’. Hence, in modern Korea and Japan, the word ‘enlightenment’ is regarded as a historical concept with no contemporary relevance. (shrink)
